A divorce is a process to legally terminate a marriage. In North Carolina, the divorce can be obtained, in most cases, after one year and one day of separation, wich starts on the date that one of the spouses moves into a separate residence. There are two kinds of divorce cases: Contested and Uncontested divorce.

Contested Divorce

In a contested divorce, the parties cannot agree to the terms of the financial settlement, or issues such as custody, child support, visitation, alimony, property division, retirement, or attorney’s fees. In this situation, the court has to intervene to make a decision on these issues.

Uncontested Divorce

In an uncontested divorce, both parties agree to be divorced and there are no issues to be resolved, or all issues have been resolved between them. In this situation, a Separation Agreement states the details about the custody and support of the minor children of the marriage and makes a fair and equitable division of property.
